Terms of Use

1. Introductory Provisions
1.1

These Terms of Use (hereinafter referred to as the "Terms") govern the legal relationship between you as a user of the service and DataVision s.r.o., with registered office at Slinková 589/2, Prague 5, 15300, Czech Republic, Company ID No.: 27142663, registered in the Commercial Register maintained in the Czech Republic (hereinafter referred to as the "Provider"), which operates the MASKIT platform.

1.2
MASKIT is an online software service provided as Software as a Service (SaaS), accessible at www.maskit.ai, which enables automated anonymization of visual and textual data.
1.3
By using the MASKIT platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you are not permitted to use the service.
1.4
These Terms apply to all users of the platform, regardless of the country from which they access the platform.
2. Description Of The Service
2.1
MASKIT is an online platform provided as Software as a Service (SaaS) that enables automated processing and anonymization of visual data, including photographs, video recordings, and individual image frames, as well as other types of digital content supported by the platform. The service uses artificial intelligence technologies to detect and anonymize selected elements, such as faces, vehicle registration plates, or entire human figures. The service aims to protect the privacy of individuals appearing in photographs or other records and to facilitate data processing in compliance with applicable laws and regulations on personal data protection.
2.2
The main functions of the service include, in particular:
  • anonymization of faces, vehicle registration plates, and entire figures of persons in photographs and video recordings;
  • real-time processing of data without permanent storage;
  • anonymization of textual information (within the scope of available functionality at a given time);
  • recording only the necessary technical log data (such as time, method, result) for the purposes of billing and support.
2.3
The service is intended exclusively for legal purposes. Use of the service for any activity that violates applicable laws, regulations, or these Terms is expressly prohibited.
2.4
All uploaded files are processed fully automatically and are not accessible to human operators. Upon completion of processing, no input or output data is stored. The system only retains technical logs of the request processing, including information on processing time, type of operation, and result (success/failure).
2.5
The Provider guarantees that anonymization is irreversible, meaning that after processing, the original content cannot be restored, even using advanced tools including artificial intelligence.
2.6
The MASKIT service infrastructure operates exclusively within the territory of the European Union. The service backend runs on cloud infrastructure leased by the Provider, while AI components may run on the Provider's own physical servers located within the same territory.
2.7
Access to the MASKIT service is provided via a secure web interface. Selected service functions may be chargeable through a credit system. API access is available in all plans, with the scope and capabilities differing according to the chosen plan. API documentation is available online and is part of the service.
2.8
The Provider may provide publicly accessible demonstrations (demos) of the service's functionality on its websites or via other channels. These demos serve solely illustrative and marketing purposes and are not considered service provision under these Terms.
3. Access To The Service And Registration
3.1
Access to the MASKIT service is granted exclusively to registered users. Registration takes place via an online form on the Provider's website and is conditional upon acceptance of these Terms.
3.2
The user is obliged to provide true and up-to-date information during registration. In case of changes to this information, the user must update it in their user account without undue delay.
3.3
Each user is responsible for maintaining the confidentiality of access credentials to their account. The Provider is not responsible for any misuse of the account by a third party.
3.4
The Provider reserves the right to verify the user's country of origin for the purpose of correctly applying the tax regime (e.g., VAT). This information may be verified based on the billing address, IP address, or other usual technical means.
3.5
The Provider further reserves the right to refuse or cancel registration, especially in cases where:
  • there is suspicion of abuse of the service;
  • it is not possible to determine the user's tax residency with sufficient certainty;
  • these Terms have been violated.
3.6
Access to advanced functions of the service is conditioned on prior payment or consumption of available credits. API access is available in all plans, with the extent of usage and available operations varying according to the chosen plan. API access is active from registration in the Free plan.
3.7
Users may utilize the service either as individuals or within a corporate account, which allows management of multiple user accesses under a single payer (organization). The corporate account has one main administrator who can create, modify, and revoke access for other users belonging to this account. The number of connected users is not limited. All users share a common credit balance, and service consumption is managed within one subscribed tariff (regardless of the number of users). The administrator is responsible for managing accesses and for payment of all consumed services.
4. Prices, Payments, And Credits
4.1
The MASKIT service is charged based on prepaid credits. Prices for individual functions are listed in the platform interface and may be expressed as the number of credits required for a specific operation (e.g., anonymization of one photograph).
4.2
Credits can be purchased via an integrated payment gateway. Users may pay by credit card. All payments are made in advance, and the service is provided only after successful payment confirmation.
4.3
All payments for the MASKIT service, including the purchase of credits, are processed through the secure payment platform Stripe. When purchasing, the user provides necessary payment details directly to this platform. The Provider does not have access to payment card data. Payment processing is governed by Stripe's terms and conditions, which are available at https://stripe.com. By using the MASKIT service, you also consent to the processing of your data by this payment service provider.
4.4
The user explicitly agrees that the Provider is authorized to initiate one-time or recurring payments from their payment card via the Stripe service for the purpose of purchasing credits or paying monthly tariffs. The payment amount is determined either:
  1. based on the user's selection of a specific package or plan, or
  2. based on the actual quantity of ordered credits.
For monthly tariffs, payment is charged repeatedly according to the selected period (monthly or annually) until the user cancels the service. Credit purchases are charged as one-time payments. Information on current prices and payment options is provided in the user interface.
4.5
The Provider reserves the right to determine the applicable tax regime (especially VAT) based on the user's registered address, place of business, or usual residence, as inferred from the provided data, IP address, and other technical parameters. In case of uncertainty, the provision of services may be suspended until verification is completed.
4.6
The user is responsible for selecting the correct tariff and purchasing the necessary amount of credits according to their actual usage. The Provider is not liable for exceeding the required number of credits or for inefficient use thereof.
4.7
The service is provided on a "pay-as-you-go" basis, where the exact amount corresponding to the number of processed items (such as photographs, video recordings, or individual video frames) is deducted from the credit balance according to the applicable price list.
4.8
All prices stated on the website are exclusive of VAT unless explicitly stated otherwise.
4.9
The MASKIT service is offered in several plans (also referred to as tariffs), which differ in price, credit volume, available features, API access, and support level. The current overview of plans is available on the service's website.
4.10
Offered Plan Versions (Tariffs):
  • Free - a free plan with a limited monthly credit allowance and limited API access. Intended exclusively for testing purposes. Outputs may contain watermarks. Basic API access and documentation are included in this plan. Creation of only one user account per person or entity is allowed under the Free plan. The Provider reserves the right to restrict or cancel access to the Free version in cases of reasonable suspicion of repeated account creation from different email addresses to circumvent rules. The option to configure anonymization settings is available only to a limited extent. Requests under the Free plan are processed in a queue with lower priority. Paid plan users receive prioritized processing without waiting.
  • Hobby - a plan for individuals with limited functionality and standard API access. The option to configure anonymization can be available only to a limited extent.
  • Professional - a plan for professional use with prioritized processing, full API access, extended anonymization options including individual settings.
  • Business - a corporate plan with high limits, full API access including individual settings, SLA 99%, technical support, and options for advanced integration and batch processing of larger data volumes.
  • Enterprise - a plan negotiated individually for large organizations, offering a dedicated API environment, on-premise solutions, direct technical support, and the highest priority processing. It also includes the possibility to customize anonymization parameters according to the specific requirements of the client (tailored solution).
4.11
Transitions between individual plans are possible through the platform interface. The user acknowledges that changing the plan may affect monthly fees, the scope of available functions, and rules for credit consumption.
4.12
Access to the Application Programming Interface (API) is included in every plan, with limitations on usage, processing speed, and available functions varying by plan. API documentation is provided online at docs.maskit.ai and is part of the service.
4.13
MASKIT distinguishes between two types of credits:
  1. Tariff credits, which are part of some tariff bundles (e.g., monthly subscriptions). These credits have a limited validity of 30 days from the date they are credited to the account and cannot be transferred between accounts. Unused tariff credits expire without compensation after the validity period.
  2. Universal credits, which can be purchased separately in predefined amounts (e.g., 250, 1,000, or 10,000 credits). These credits have a validity of 12 months from the purchase date, and can be used for any function of the service. Their price may vary depending on the chosen plan.
4.14
When consuming credits, the following automatic usage order applies:
Unused tariff credits expire without compensation after the validity period, even if the user has active universal credits.
  1. Active credits from tariff bundles (tariff credits) with the nearest expiration date are consumed first.
  2. Universal credits are consumed only afterwards.
4.15
In case of an upgrade to a higher tariff during the current period (e.g., transition from Hobby to Professional), the user is charged only the proportional price difference between tariffs for the remaining period. The original billing period remains unchanged. Upon upgrade, users are immediately granted the benefits of the higher tariff, including the corresponding number of credits.
4.16
Downgrade to a lower tariff (e.g., from Professional to Hobby) is possible only after the current prepaid period has expired. Universal credits remain valid even after changing the tariff.
4.17
Termination of the user account ends access to the service, and all unused credits, tariffs, and benefits expire without compensation. Termination of the account does not entitle the user to a refund of already paid amounts. The Provider reserves the right to retain necessary system records and technical logs related to account operation (e.g., credit consumption records, request history, billing information) for a period of 6 months after account termination, for purposes of audit, billing, or legal certainty.
4.18
The Provider reserves the right to modify the plan offerings, their content, and pricing terms at any time. In case of significant changes, users will be notified at least 14 days in advance. Apart from this compensation, the Provider shall not provide any further compensation.
6. Technical Availability And Service Maintenance
6.1
The Provider strives for high availability of the MASKIT service and commits to ensuring an average availability of at least 99% in each calendar month.
6.2
Planned outages, which will be announced to users at least 24 hours in advance, and outages caused by force majeure or circumstances beyond the Provider's control (e.g., internet connectivity outages, cloud infrastructure failures, cyberattacks, natural disasters, etc.) are excluded from the availability calculation.
6.3
Planned outages (e.g., system maintenance or updates) will be conducted, whenever possible, outside normal working hours and users will be informed via the web interface or email.
6.4
In the event of a service outage lasting longer than 48 hours, unless caused by force majeure, the user is entitled to request a reasonable compensation in the form of replacement credits credited to their account, with the amount of compensation depending on the extent of the outage and the actual disruption of the provided services.
6.5
The user acknowledges that the MASKIT service is provided in its current technical state and may be continuously improved or modified. The Provider reserves the right to change parameters, interface, and service functionality, while ensuring the preservation of its core functions.
6.6
The MASKIT service is operated on infrastructure located within the European Union, including both cloud and physical servers. The Provider ensures that all data processing complies with applicable personal data protection and security regulations. User data is not transferred outside the EU without their explicit consent.
7. Data Processing And Privacy Protection
7.1
When using the MASKIT service, users upload visual data (such as photographs or video recordings) or textual data that may contain personal data. The Provider processes this data solely for the purpose of providing anonymization functionality.
7.2
Data uploaded to the platform is not stored. It is processed in real-time as part of machine-to-machine communication between the user and the Provider's server, and upon completion of the operation, the data is removed from the infrastructure. Due to this setup, data is not further deleted because it is not stored at all.
7.3
For billing, credit consumption tracking, and operational security purposes, the Provider retains minimal technical logs of performed operations. These logs include the identity of the calling account, used functionality, date and time of the request, number of credits deducted, processing result (success/failure), and other necessary operational information. These logs do not contain any uploaded input data or their content.
7.4
All processing takes place exclusively on infrastructure located within the EU. The Provider does not transfer any data outside the territory of the European Union.
7.5
The Provider takes care to protect privacy and process personal data in accordance with Regulation (EU) 2016/679 (GDPR). Details on personal data processing are provided in a separate document titled "Personal Data Processing Policy," which is available on the service's website.
7.6
The Provider may use third-party services (e.g., the STRIPE payment gateway) to facilitate the payment process. These third parties process personal data in compliance with their own personal data protection policies and act as independent controllers.
7.7
The user agrees to upload only such data to the service for which they have lawful authorization to process. In case of breach of this obligation, the user bears full responsibility for any consequences resulting from unauthorized processing of personal data.
7.8
In case of technical problems, inquiries, or support needs, the user may contact the Provider's technical support via email at support@maskit.ai. Support is available on working days from 9:00 to 17:00 Central European Time.
8. Limitation Of Liability And Performance Guarantee
8.1
The Provider makes all reasonable efforts to ensure that the MASKIT service is available and functional 99% of the time during each calendar month ("SLA"). Planned outages, of which the user is informed in advance, as well as outages caused by force majeure or actions of third parties beyond the Provider's control, are excluded from the guaranteed availability.
8.2
In case of planned outages, the user will be informed at least 24 hours in advance via email or notification in the user interface. Planned outages will, if possible, be scheduled outside normal working hours.
8.3
In the event of a service outage lasting longer than 12 consecutive hours, unless caused by force majeure or violation of the Terms by the user, the user may request compensation in the form of credits credited according to the SLA. The amount of compensation depends on the duration and impact of the outage.
8.4
The Provider commits to continuously improving and developing the platform. The user acknowledges that, as a result, there may be adjustments to algorithms and functionalities, while backward compatibility will be maintained to a reasonable extent.
8.5
The user acknowledges that anonymization results may in some cases exhibit a degree of inaccuracy. The Provider makes no express or implied warranty that any algorithm instance will be 100% accurate, whether processing photographs or video recordings. The service is provided "as is".
8.6
Due to the automated nature of the MASKIT service, the user is responsible for verifying the output data and their subsequent use. The Provider is not liable for any damages resulting from improper or inappropriate use of the service outputs.
8.7
The user has the right to discontinue use of the service at any time. The Provider reserves the right to restrict or terminate the user's access to the service in case of repeated violation of these Terms or justified concerns about operational, security, or third-party rights breaches.
9. Liability And Compensation For Damage
9.1
The Provider is liable for damage caused by breach of its obligations under these Terms, unless the breach was due to circumstances excluding liability (force majeure) or due to improper or unauthorized use of the service by the User.
9.2
The User acknowledges that anonymization results are generated automatically using machine learning algorithms, and their accuracy depends on the nature of the input data. The Provider does not guarantee the completeness or error-free nature of the outputs and is not liable for consequences of their use.
9.3
The MASKIT service is provided "as is" without express or implied warranties. The User is responsible for verifying the suitability of the outputs for their specific purposes.
9.4
The Provider shall in no event be liable for:
  • lost profits;
  • business interruption;
  • loss of data;
  • consequential, indirect, or punitive damages;
  • claims of third parties arising from the use of service outputs.
9.5
The Provider's total liability for any claims by the User is limited to the amount corresponding to the price of credits purchased by the User within 30 days prior to the damage occurring. This limitation does not apply in cases of intentional misconduct or gross negligence by the Provider.
9.6
Circumstances excluding liability (force majeure) include, in particular: natural disasters, outages of cloud or network infrastructure, war, pandemic, government interventions, cyberattacks beyond the Provider's control, and other events that make it impossible to fulfill contractual obligations regardless of the Provider's will.
10. Changes To The Terms
10.1
The Provider reserves the right to unilaterally change these Terms at any time, especially in the case of changes to legal regulations, expansion of service functionality, or adjustments to business terms.
10.2
The user will be informed about each change to the Terms at least 14 days before their effectiveness, via email sent to the registered address or a notification in the user interface of the platform.
10.3
If the user does not agree with the change to the Terms, they are entitled to cancel their user account and stop using the service before the changes take effect. If the user continues to use the service after the new Terms become effective, they are deemed to have expressly agreed to the changes.
10.4
In the event of account cancellation due to disagreement with the change in Terms, the user is not entitled to a refund of already purchased but unused credits.
11. Account Management And Service Termination
11.1
The user may terminate the use of the MASKIT service at any time by deleting their account in the account settings. Requests to delete the account can only be made by the account administrator.
11.2
The Provider reserves the right to terminate the provision of the service to a specific user if:
  • the user has not used the service for more than 12 consecutive months (account inactivity);
  • the user repeatedly violates these Terms;
  • the operation of the service ceases to be sustainable for operational, security, or business reasons.
11.3
In the event the service is terminated by the Provider, the user will be informed via email linked to their account at least 30 days before the planned termination.
11.4
The Provider also reserves the right to completely discontinue the operation of the MASKIT service at any time. In such case, all active users will be informed at least 60 days in advance. Users will be refunded unused credits exceeding 10 EUR if they request a refund within 30 days of the termination notice.
12. Final Provisions
12.1
These Terms are governed by the laws of the Czech Republic. Any disputes arising from the use of the MASKIT service or in connection with these Terms shall be resolved on the merits by the competent local court in the Czech Republic.
12.2
The Provider reserves the right to unilaterally change these Terms at any time. The user will be notified of the change by email or other notification in the user interface. The new wording of the Terms becomes effective on the date specified therein, but not earlier than 30 days after notification.
12.3
These Terms are drawn up in Czech and English. In case of conflict between language versions, the Czech version shall prevail.
12.4
The legal relationship between the Provider and the user is governed by the laws of the Czech Republic. All disputes will be decided by the competent courts of the Czech Republic.
12.5
These Terms come into force and effect on the date of their publication on the website www.maskit.ai, unless otherwise specified.
